Decision on investment policy of Gilimex Thua Thien Hue Industrial Park

Deputy Prime Minister Le Van Thanh has just signed Decision No. 1050/QD-TTg dated September 7, 2022 approving the investment policy  of the Gilimex Thua Thien Hue Industrial Park project, quoting the following contents:

– Pursuant to the Law on Government Organization dated June 19, 2015; Law amending and supplementing a number of articles of the Law on Government Organization and the Law on Organization of Local Government dated November 22, 2019;

– Pursuant to the Law on Investment dated November 26, 2014;

– Pursuant to the Law on Investment dated June 17, 2020;

– Pursuant to the Government’s Decree No. 118/2015/ND-CP dated November 12, 2015 detailing and guiding the implementation of a number of articles of the Law on Investment;

– Pursuant to the Government’s Decree No. 82/2018/ND-CP dated May 22, 2018 regulating the management of industrial parks and economic zones;

– Pursuant to the Government’s Decree No. 148/2020/ND-CP dated December 18, 2020 on amending and supplementing a number of Decrees detailing the implementation of the Land Law;

At the request of the Ministry of Planning and Investment in Official Letter No. 8755/BKHDT-QLKKT dated December 29, 12, 2020 on the dossier of decision on investment policy of Gilimex industrial park infrastructure investment project.

DECIDE:

Article 1. Decide on investment policies for Gilimex industrial park infrastructure construction and business projects with the following principal contents:

  1. Investor: Gilimex Industrial Park Corporation.
  2. Project name: investment in construction and infrastructure business of Gilimex industrial park.
  3. Project objectives: investment and business in industrial park infrastructure.
  4. Land use scale of the project: 460.85 ha.
  5. Project location: Phu Bai ward and Thuy Phu commune, Huong Thuy town, Thua Thien Hue province.
  6. Total investment capital of the project: VND 2,614 billion, of which the developer’s contributed capital is VND 392.17 billion.
  7. Project implementation progress: The People’s Committee of Thua Thien Hue province shall direct the Management Board of the economic and industrial zone of Thua Thien Hue province to guide the investor in detail the project implementation progress as prescribed at Point d, Clause 8, Article 33 of the 2014 Law on Investment,  in which, it is noted that the progress of the investor’s equity contribution to the implementation of the project must ensure compliance with the provisions of land law.
  8. Project implementation duration: 50 years from the date of issuance of the Investment Registration Certificate.
  9. Investment incentives: comply with current laws.

Article 2.Responsibilities of the  People’s Committee of Thua Thien Hue province

  1. To ensure the accuracy of reported information, data, contents of reception, explanation and appraisal in accordance with the provisions of law; the implementation of the Project in conformity with the plannings approved by competent authorities; No lawsuits occur.
  2. To be responsible for proposing the selection of investors to execute the project satisfying the conditions prescribed by the law on investment, bidding, land, real estate business and other relevant laws.
  3. To receive opinions of ministries and branches.
  4. Organize land recovery, compensation, site clearance, land lease, change of land use purposes for the implementation of the Project in accordance with documents approved by competent authorities on the scale, location and progress of land use for the Project.

Comply with the provisions of the law on planning, the law on land and relevant laws in the process of organizing and approving the planning and land use plan of Huong Thuy town, Thua Thien Hue province.

Ensure that there are no disputes or complaints about the right to use the project site. Investors satisfy the conditions for land lease by the State and permission to change land use purposes in accordance with law.

  1. Plan to add land area or increase the efficiency of other rice land to compensate for the conversion of rice land as prescribed in Article 134 of the 2013 Land Law. Investors must pay a sum of money to protect the development of rice land according to regulations.
  2. To be responsible for ensuring the change of production forest land use purposes in the land use purpose change target permitted by the Government in the Government’s Resolution No. 72/NQ-CP dated June 06, 2018 on adjustment of land use planning to 2020 and final land use plan (2016 – 2020) of Thua Thien Hue province; comply with the provisions of the Law on Forestry, Decree No. 156/2018/ND-CP dated November 16, 2018 of the Government detailing the implementation of a number of articles of the Law on Forestry, Decree No. 83/2020/ND-CP dated July 15, 2020 of the Government amending and supplementing a number of articles of Decree No. 156/2018/ND-CP.

Ensure that the investor is only allowed to implement the project after being decided by the Prime Minister to change the forest use purpose in the project area in accordance with the provisions of the law on forestry.

Instruct the Management Board of the economic and industrial zone of Thua Thien Hue province to request investors to plant alternative forests or fulfill their responsibilities to pay money for replacement afforestation when changing the purpose of using forest land to another purpose as prescribed in Clause 4, Article 19 of the Law on Forestry.

  1. To direct the Management Board of the economic and industrial zone of Thua Thien Hue province to request investors to: receive opinions of ministries and sectors; escrow to ensure the execution of the Project in accordance with regulations; ensure sufficient contribution of equity capital to the implementation of the Project, including in case the enterprise invests in investment projects and other business activities outside this Project; comply with the provisions of the law on environment and the contents of the approved environmental impact assessment report of the project; request the Investor to comply with the detailed construction planning of the Project.
  2. To direct the Economic and Industrial Zone Management Board of Thua Thien Hue province and relevant agencies:
  •     Request the Investor to implement the Project only after the Environmental Impact Assessment Report of the Project is approved.
  •     Supervise and evaluate the implementation of the Project, including capital contribution and mobilization of investment capital of the Investor in accordance with the provisions of law.
  •     Coordinate with investors in implementing compensation and site clearance plans according to regulations. In the process of implementation, it is recommended to note solutions related to workers’ lives; plans on construction of housing, social, cultural and sports works for industrial park employees; job support and vocational training for people subject to land confiscation; carry out land acquisition in accordance with the project implementation progress and attract investment to minimize impacts on people subject to land confiscation.

III. Article 3. Enforcement Terms

  1. This Decision takes effect from the date of signing.
  2. The Chairman of the People’s Committee of Thua Thien Hue province, the investor specified in Article 1 and relevant organizations and individuals shall be responsible for the implementation of this Decision.
